Thorpe Insulation Mailing
Many of our clients recently received a document from the United States Bankruptcy Court for the Central District of California related to the Thorpe Insulation Company bankruptcy. The document is entitled “Election to change prior vote to accept or reject the Joint Plan of Reorganization.”
In 2008, Thorpe Insulation held a vote on its Plan of Reorganization. At that time, we recommended our clients vote to accept the Plan. Thorpe has made modifications to its Plan and Brayton Purcell still recommends our clients accept the Plan.
- If a you voted ‘yes’ during the 2008 voting, your vote still counts in favor of the plan you do not need to do anything.
- If you voted no or did not vote, you do not need to do anything.
- If you previously voted yes and now would like to vote ‘no’, against Brayton Purcell’s advice, you must fill out the form and return it to the voting agent in Los Angeles by May 22, 2009.
G–I Holdings Inc. (fka GAF Corporation)
After seven years in Chapter 11 bankruptcy proceedings, G–I Holdings Inc. (fka GAF Corporation) has put together a plan for reorganization. In order for the plan to be approved, the majority of claimants, including all asbestos creditors throughout the United States, and the bankruptcy judge, must approve the plan. G-I Holdings’ reorganization plan proposes setting up an asbestos trust to process asbestos claims and pay qualified claimants.
The deadline for submitting G-I Holdings’ (or GAF) ballots to vote on the proposed plan was January 23, 2009. Ballots were to be received by 4:00 pm Eastern Standard Time. If you failed to return the ballot before this deadline, you will not be barred from submitting a bankruptcy claim if or when the plan is approved and a trust is established. Our office will be monitoring the bankruptcy proceedings. As soon as a trust is set up and begins processing claims, we will submit for all our qualifying claimants.
