Mesothelioma Victim’s Widow, Represented by Brayton Purcell, Named to Chrysler Bankruptcy Committee

Appointed to the Official Committee of Unsecured Creditors in the Chrysler bankruptcy proceedings is the widow of a mesothelioma victim represented by Alan Brayton and Christina Skubic of Brayton Purcell, LLP. The appointment was announced on May 5 and filed with the U.S. Bankruptcy Court, Southern District of New York on May 6, 2009, by Diana Adams, U.S. Trustee. By serving on the Chrysler committee, the widow, through her asbestos attorneys, will represent the interests of all unsecured creditors, working to protect the interests of those who have suffered from asbestos related diseases such as mesothelioma. The widow’s husband, who died from mesothelioma, was exposed to asbestos dust from Chrysler’s asbestos-containing brakes.

Chrysler Bankruptcy–A Brief Overview

In a move to pursue an alliance with Italian automaker Fiat, Chrysler filed for federal bankruptcy protection on April 30, 2009. As outlined in Chrysler’s government-sponsored plan, the United Automobile Workers (UAW) will take control of Chrysler through their retirement plan. Fiat will be a junior partner along with the U.S. and Canadian governments. By filing a Chapter 11 bankruptcy, Chrysler will be able to renegotiate its current debt structure as well as other financial obligations such as those filed by asbestos claimants. Throughout the bankruptcy negotiations, the widow through her counsel, Brayton Purcell, will represent the interests of asbestos claimants, including those suffering from mesothelioma and lung cancer.

Asbestos, often a component in brake pads and linings, clutch facings, and various gaskets, can become airborne during routine automotive maintenance procedures.
