Are Retired Workers Entitled to Compensation for Mesothelioma?

by Brayton Purcell LLP | Aug 29, 2016 | Workers' Compensation

If you are a worker who has been diagnosed with an asbestos-related disease, like mesothelioma, you might be entitled to compensation for your pain and suffering, medical bills, and more.

In many cases, 20th-century workers in blue-collar occupations came into contact with asbestos at their place of work. Raw asbestos fibers have been worked into thousands of consumer products over the years. Throughout history, workers have been known to develop serious respiratory conditions after working around the substance for prolonged periods of time.

What is surprising is the fact that the asbestos industry, as well as many employers, knew of the dangers of asbestos, yet allowed workers to be exposed to it. According to a recent Huffington Post article, some went as far as to say, “if you have enjoyed a good life while working with asbestos products why not die from it” (E.A. Martin, Bendix Corporation, Sept. 12, 1966). In the eyes of asbestos manufacturers, workers were privileged to die premature and painful deaths due to exposure to asbestos.

Many mechanics, construction workers, and even veterans worked around asbestos day after day, for years on end. This prolonged exposure put workers especially at risk for fatal diseases and cancers, like mesothelioma. Because of the latency periods of such diseases, victims are likely to be retired by the time they are diagnosed.

Retiring from an occupation that exposed you to asbestos does not disqualify you from obtaining compensation for your work-related condition. If you are a retired blue-collar worker who has been diagnosed with mesothelioma, do not hesitate to reach out to one of our experienced attorneys today.
